A Biden-appointed judge is on the verge of blocking President Trump’s executive order on transgender troops, arguing that the assertion only two genders exist is “not biologically correct.”
U.S. District Judge Ana Reyes made it clear where she stands during Tuesday’s hearing, grilling DOJ attorneys and showing deep skepticism about the policy’s impact on military readiness. At one point, she mocked the idea that limiting transgender service members would affect “the greatest fighting force in world history.”
Trump’s executive order, signed January 27, directed the Department of Defense (DOD) to update medical standards for military service and reverse previous policies that prioritized transgender inclusion over military readiness. As a result, gender-affirming care for service members was paused, and further restrictions on transgender service are expected.
Judge Reyes, however, appears unconvinced. Though she hasn’t issued an official ruling yet, she all but admitted she’s already made up her mind, saying that “smarter people on the D.C. Circuit would have to tell me I’m wrong.”
With the DOD finalizing its policy soon, Reyes is holding off on a formal order but seems ready to strike down Trump’s directive.
