The Maryland House of Delegates has passed a new bill that permits the sale of condoms in vending machines located in public schools. This legislation, sponsored by Delegate Nicole Williams from Prince George’s County, seeks to overturn the current prohibition on selling contraceptives in school vending machines.

The bill, known as House Bill 380, includes several key provisions:

  • Vending Machine Sales: The bill allows condoms to be sold in vending machines in nursery schools, preschools, elementary schools, and high schools. This provision aims to make contraceptives more accessible to students in these educational settings.
  • Removal of Penalties: The bill eliminates the $1,000 misdemeanor criminal penalty that was previously associated with selling contraceptives in these institutions. This change reduces the legal and financial risks for schools that choose to provide contraceptives through vending machines.
  • School Discretion: Importantly, the bill does not mandate that schools must sell condoms. Instead, individual school systems have the discretion to decide whether to install vending machines that dispense contraceptives. This allows each school to make decisions based on its specific community needs and values.
  • Public Health Focus: The overarching goal of the bill is to improve public health by increasing access to contraceptives.
