
FORMER Senator Rod Culleton has filed a complaint with the Australian Federal Police against the Australian Electoral Commissioner.
In a live Facebook feed from his Great Australian Party election campaign bus today (May 28th), Mr Culleton read out his complaint in which he alleges the 2025 Federal Election is being conducted illegally.
“Since the passing of Queen Elizabeth II, no new law has been passed by the Australian Parliament to recognise King Charles III as King of Australia. No Royal Proclamation has been issued under an Act of Parliament to confirm the new Sovereign title.
“Despite this, election writs that must lawfully come from the Crown’s authority, have been issued to the 2025 election. This action, carried out by, or under the supervision of the Australian Electoral Commissioner raises grave constitutional and legal issues.
“Key point: Australia’s Crown is now legally separate from the United Kingdom’s Crown. The Royal Styles and Title Act 1973 (C’wealth). refers only to Queen Elizabeth II. No new Act of Parliament has been passed to give lawful license for a new Royal Proclamation or the valid issue of Writ under King Charles III.
“Canada, by contrast, passed legislation in 2023 to formally recognise King Charles III’s title before continuing key government functions like elections.
“Without update law, the authority for the election writs is legally questionable. I request for investigation and ask that the Australian Federal Police in my defence, urgently investigate whether the Australian Electoral Commissioner has acted unlawfully and in breach of his Constitutional duties; whether the Commissioner may have committed an offence under the Australian Criminal Code including misfeasance in public office and whether the 2025 Federal Election is proceeding under invalid or defective authority.
“This formal notice and this letter also puts the Australian Electoral Commissioner on notice: Proceeding without lawful validation of the Sovereign’s authority endangers the integrity of the election, the Constitutional order of the Commonwealth, and may constitute serious criminal conduct.
“I reserve my full legal rights in relation to this matter and stand ready to provide further evidence if required. Signed Former Senator Rodney Norman Culleton.”
