Both Labor and Liberal parties have for decades surreptitiously removed the inalienable right of an accused to be judged by his peers in court proceedings.
Instead the ‘State’ will supplant a jury with a magistrate or judge in the pay of the particular partisan government. In natural law there can be no such entity as an impartial judicial officer. Rarely will he or she rule against the ruling party junta. This officer had originally been appointed by the old boys club to do the bidding of the political regime.
These star chambers overseen by a single partisan judge do not deliver justice. Justice has not been served in Australia for decades. Justice is available only to those with the deepest pockets and even then those defendants who do not share similar political views to the judicial officer are seldom acquitted.
When defendants appear before a judicial officer asking for their right to have a jury, it is denied. The reason given will be: “I am bound by law not to allow a jury trial.”
Proper summary jurisdiction for cases to be heard by Justices of the Peace has been thrown out the door to be replaced by partisan puppets. From Wikipedia:
‘Summary jurisdiction, in the widest sense of the phrase, in English law includes the power asserted by courts of record to deal brevi manu with contempts of court without the intervention of a jury. Probably the power was originally exercisable only when the fact was notorious, i.e. done in presence of the court. But it has long been exercised as to extra curial contempts.
The term is also applied to the special powers given by statute or rules to the High Court of Justice and to county courts for dealing with certain classes of causes or matters by methods more simple and expeditious than the ordinary procedure of an action. But the phrase in modern times is applied almost exclusively to forms of jurisdiction exercised by justices of the peace out of general or quarter sessions, and without the assistance of a jury.’
The entire judicial system in Australia s in a terrible mess thanks to partisan politics and can only be remedied by starting again from scratch.
