The Director of National Intelligence just detonated a political bombshell. Tulsi Gabbard, speaking on Fox News and backed by newly declassified files, has formally referred Barack Obama and multiple senior officials from his administration to the Department of Justice for potential criminal prosecution. The charge: orchestrating a years-long intelligence operation to delegitimize Donald Trump’s 2016 election win. Gabbard’s statement wasn’t vague. She called it a “treasonous conspiracy” and said the evidence shows these officials “manufactured and politicized intelligence” to build the Russia collusion narrative.
The documents released on July 18 include internal memos, emails, and a suppressed Presidential Daily Brief dated December 8, 2016. That brief, compiled by the CIA, FBI, NSA, DHS, and others, concluded that Russian actors “did not impact recent US election results” through cyber activity. It also stated that attempts to compromise voter databases were unsuccessful and “highly unlikely” to have altered any state’s vote count. The FBI and NSA had expressed “low confidence” in attributing the DNC leaks to Russian intelligence. That assessment was buried. Within 24 hours, Obama’s national security team convened in the White House Situation Room and ordered a new intelligence report. That report, released January 6, 2017, reversed course and claimed Russia had interfered to help Trump.

Gabbard named names. James Clapper, John Brennan, Susan Rice, John Kerry, Loretta Lynch, and Andrew McCabe were all present at the December 9 meeting. She alleges they knowingly pushed false intelligence, citing the Steele Dossier despite its lack of credibility. The DNI’s memo accuses these officials of leaking to media outlets like the Washington Post to seed the narrative that Russia had altered the election outcome. The goal, according to Gabbard, was to “subvert the will of the American people” and launch a coup to remove Trump from office.
The fallout from this release is already spreading. Speaker Mike Johnson called it “dismantling the deep state.” General Mike Flynn said it confirms what many suspected for years. Gabbard has handed all supporting documents to the DOJ and demanded full prosecution. She stated, “No matter how powerful, every person involved must be investigated and prosecuted to the fullest extent of the law.” The files include redacted communications from the FBI dissenting from the original brief and emails showing the intelligence community was pressured to rewrite its findings.
This is a direct accusation of treason against a former president and his top advisors. The evidence is now public. The DOJ has it. The American people have it. What happens next will test the integrity of the justice system and the resilience of the republic.
